Recent Patent Cases at the Supreme Court

by Dennis Crouch

"4. Island IP v. TD Ameritrade (24-461) (Federal Circuit Procedure and Eligibility).
Question: Whether Federal Circuit’s practice of issuing one-word Rule 36 affirmances is proper in patent cases and whether courts are properly applying summary judgment standards on Eligibility Grounds. Most recently on December 16, 2024, the case was rescheduled. This case has substantial parallels with ParkerVision and I expect that the court will consider the two for certiorari as a pair. Charles Macedo from Amster Rothstein represents petitioner Island IP. Nicholas Brown from Greenberg Traurig represents respondent TD Ameritrade."
