米国の連邦巡回控訴裁判所(CAFC)は2009å¹´12月28日,実際に使用されていない特許や満了済みの特許を製品に記 載する“特許マーキングの間違い”に関する罰金が,製品1台当たり最高500米ドルになることを明らかにした。 過去,連邦地裁レベルでは「最高500米ドル」となる罰金適用対象の解釈についてバラつきがあった。ある製品に間違っ た特許番号が付され,その後継モデルについても間違った特許番号が付されている場合に,そうした製品シリーズを一つ とみなして最高500米ドルの罰金を科す裁判所もあれば,間違った特許番号が付された製品1台ごとに最高500米ドルの 罰金を科す裁判所もあった。今回のCAFC判決はこの解釈を統一させたものだが,特許マーキングに関して重要な課題を 企業に突きつけることになった。 特許マーキングは権利行使のために必要な手続きである。米国法では,特許を使用している製品に当該特許番号をマー キングしていなければ,第三者が当該特許を侵害した際に権利行使に支障が生じる。もし特許を使用しているにもかかわ らずマーキングを実施していなければ,自らがマーキングを開始した日,あるいは当該第三者に特許侵害の催告状を送付 した日以降の損害賠償しか回収ができない。特許所有者が正しく特許マーキングを実施していたかを調べ,その不備を挙 げることは,侵害催告を受けた側が損害賠償を限定するために多用するディフェンスの一つだ。 特許マーキングの問題は,間違った特許マーキングを発見すれば誰でも訴訟を起こせることだ。提訴の要件として,間違 った特許マーキングによる被害が必ずしも必要とはならない。訴訟の結果,損害賠償を回収し,その半分を政府に納めさ えすればよい。虚偽マーキングによる罰金を科すには,間違ったマーキングをした側に悪意があった,つまり,そのマーキ ングが正しいと合理的レベルで信じていなかったことを相手方が立証しなくてはならない。防御する側は「だますつもりはな かった」では足りない。例えば,ある特許が実際にはその製品に使用されていなかったとしても,その製品は当該特許を使 用しているという弁護士の鑑定書があり,これに基づいてマーキングを行ったのだと主張できれば,合理的レベルで特許の 使用を信じていたということになる。 今回の判決を契機に,間違った特許マーキング製品を見つけてひと稼ぎすべく,すでに100件以上の虚偽マーキング訴 訟が業界を問わず提訴されている。ソニー,東芝,富士フイルムを含む多くの日本企業に対しても虚偽マーキング訴訟が 起こされている。製品の売上高にもよるが,虚偽マーキングをした製品1台あたり最高500米ドルの罰金となると大きな額に なり得る。今回の判決を受けた虚偽マーキング裁判多発の背景には,市場において特許マーキングの状況を詳細にチェックし,虚偽マーキングの罰金で稼ごうとする第三者の存在がある。企業が以下のような対策を講じなければ,虚偽マーキン グ訴訟のリスクに自らをさらすことになるだろう。 (1)特許マーキング監査の実施 現在,米国で特許マーキングを施しているすべての製品について,マーキングしている特許が有効であり,満了していな いことを確認する。マーキングしている特許が製品に使用されているか否かについて不安がある場合は,弁護士による鑑 定書を取っておくほうが安全である。 (2)特許マーキング・ポリシーの策定・実行 定期的に特許マーキングを確認し,新たな特許のマーキングを追加する,あるいは削除する仕組みを構築し,実行する。 マーキングしている特許の満了時期の管理,それに基づくマーキングの削除は必須であり,特許が無効化された場合のマ ーキング削除への対応も取り入れる必要がある。 (3)鑑定書の取得 すべてのマーキング特許について鑑定書を取る必要はないが,使用の有無について社内で不安がある場合,弁護士の 鑑定書を取り,虚偽マーキング訴訟が提訴された場合に「使用を合理的レベルで信じていた」ことを鑑定書で証明できるよ う準備しておく。 なお,この虚偽マーキング訴訟の多発を受け,米国議会はこの訴訟を限定する法案を検討している。上院は,虚偽マー キングによって実際に被害を受けたことを提訴の要件とするように提案する可能性がある。こうした法案が最終的に可決 するまでは,企業は自ら,正しい特許マーキングの実施に努めるに越したことはない。 お知らせ:上記「虚偽マーキング訴訟」に関するセミナーを5月11日に京都で開催します。 詳細はこちら   【著者紹介】 Joseph Casino, Amster, Rothstein & Ebenstein, LLP ,パートナー 訴訟,ライセンス交渉,鑑定書準備,出願業務と広く知的財産権にかかわる法律業務を担当しており,特にハイテク産業へのサービス提供に 注力している。日本において日本企業の社内特許弁護士として勤務した経験を活かし,多くの日本企業にサービスを提供している。 David Boag, […]
