Macedo and Associate David Goldberg for the New York Intellectual Property Law Association in support of requests for en banc review by the full Federal Circuit in Arthrex v. Smith & Nephew. Law360 also quoted Mr. Macedo regarding the submission:
“We think it’s not only important that the Federal Circuit takes the case, but that they properly frame the issues,” Charles R. Macedo of Amster Rothstein & Ebenstein LLP, representing the NYIPLA, told Law360.
Arthrex involves a determination that Patent and Trial Appeal Board (PTAB) Administrative Patent Judges (APJs) were “principal officers” who, according to the U.S. Constitution, must be appointed by the president and confirmed by the Senate.
