Jessica Capasso litigates patent, trademark, copyright, trade secret and unfair competition cases, and counsels clients on protection of and contractual issues regarding intellectual property. Trained as a biological and environmental engineer, she works with a range of IP including computer technology, apparel and textile design, business method patents and materials science.

She was recently part of an ARE litigation team representing a financial institution asserting multiple business method patents against a global bank. Ms. Capasso has been centrally involved in numerous ARE litigations with responsibility for case management, drafting motions, preparing expert reports, preparing witnesses for depositions and managing discovery.

As part of the firm’s secondment program, Ms. Capasso worked in-house at a major retailer for nine months. She was involved in trademark and copyright litigation, served as liaison between the company and outside counsel, applied for copyright protection for source code underlying mobile applications and reviewed contracts with vendors and developers to acquire and transfer IP rights. The in-house experience also gave her invaluable insight into corporate priority setting, constraints, budgeting and approval processes, as well as evaluation of outside counsel.

Ms. Capasso began her legal career as a Summer Associate at Amster, Rothstein & Ebenstein LLP in 2008, and returned to the firm as an Associate in 2009.

Prior to law school, Ms. Capasso worked as an environmental consultant and acoustical engineer in San Diego, California, an experience that honed both technical and problem-solving skills. She advised commercial and residential real estate developers on regulatory compliance and design issues involving storm water, drainage, noise and other environmental considerations.
