

Kenneth M. Bernstein has extensive experience providing strategic counseling to clients in all aspects of intellectual property law, including patents, trademarks, copyrights, and related matters. He has litigated intellectual property cases before numerous federal and state courts and administrative agencies, including the Federal Circuit Court of Appeals. He has drafted and negotiated complex intellectual property licensing, research, product development and supply agreements. He has also provided product clearance, patentability and trademark opinions and has been involved in the prosecution and enforcement of intellectual property portfolios. Relevant subject areas include telecommunications, computers, camcorders, batteries, apparel, business methods and an assortment of mechanical and medical devices. Mr. Bernstein has represented multinational companies such as Panasonic and JVC, as well as smaller ventures such as Phoenix Industries and Sales Optimization Group.
Mr. Bernstein is a native New Yorker born in 1962. He attended Columbia College, received a computer science degree in 1984, and worked for CBS Corporation from 1984-86 as a systems analyst. He subsequently attended Columbia Law School, where he was a Harlan Fiske Stone Scholar and received his J.D. degree in 1989. From 1989-98, Mr. Bernstein was a commercial litigator at the law firm of Davis, Polk & Wardwell. His case load included matters involving corporate conflicts, mergers and acquisitions, and high-tech business litigation. He joined Amster, Rothstein & Ebenstein LLP in 1998 to focus exclusively on intellectual property law and has been a partner of the firm since 2004.
